ARGENTINA PURA S.L., as the Data Controller, informs you that in accordance with Regulation (EU) 2016/679 of April 27 (GDPR) and the Organic Law 3/2018 of December 5 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), we will process your personal data as described in this Privacy Policy.

This Policy outlines how we collect your personal data, why we collect it, what we do with it, who we share it with, how we protect it, and your rights regarding the processing of your data.

This Policy applies to the processing of personal data collected by the company in connection with the provision of its services. Where you request a travel quote or plan a trip, part of your data is shared with our local operating partner in Argentina, as explained in Section 6.

We are committed to delivering our services with the highest standards, which includes ensuring the security and transparency of your personal data. Our core principles are:

  • Lawfulness: We only collect your personal data for specific, explicit, and legitimate purposes, such as responding to your enquiry, preparing travel quotes, managing travel bookings, reserving spots, informing authorities of participants, registering with travel insurance, and contracting third-party services like flights, transfers, excursions, or hotels.
  • Data minimization: We collect only the data strictly necessary for the intended purposes.
  • Purpose limitation: We will not process your personal data for purposes other than those stated.
  • Accuracy: We ensure your data is accurate and kept up to date.
  • Data security: We implement appropriate technical and organizational measures to prevent unauthorized access, disclosure, alteration, or destruction of your data.
  • Access and rectification: You can access or request rectification of your data at any time.
  • Retention: We retain personal data only as long as necessary for the purpose it was collected.
  • International transfers: Where your data is transferred outside the EU/EEA, it is protected in accordance with Section 7.
  • Third parties: Any access to or transfer of personal data to third parties is done in compliance with applicable laws and with adequate contractual guarantees.
  • Direct marketing and cookies: We use cookies to collect data for commercial purposes and to enhance customer service quality.

4. COLLECTION AND PROCESSING OF YOUR DATA

The personal data we may collect includes:

  • Identification data: Full name, date of birth, personal ID numbers (e.g., passport, NIE, DNI), nationality, and document expiration dates.
  • Contact data: Email address, phone number, and physical or tax address.
  • Travel data: Destinations of interest, estimated travel dates, number of travellers, budget range, and preferences you share with us to prepare your trip.

We also collect certain data automatically when you visit our website, as described in our Cookie Policy.

Special category data (health / accessibility). If, in order to tailor your trip (for example for accessibility, mobility, dietary or medical needs), you voluntarily provide health-related information, we will process it only on the basis of your explicit consent (Art. 9 GDPR), solely to arrange your trip, and we will share it with the Local Operator (Section 6) only to the extent strictly necessary to operate your trip safely. Please do not send us health information unless it is necessary for your trip.

We collect and process this data for the purpose of:

  • Responding to your enquiry and preparing travel quotes.
  • Providing services, products, and relevant information.
  • Sending communications and marketing updates, where permitted.

5. LEGAL BASIS

We process your data in accordance with applicable data protection laws based on one or more of the following grounds:

  • Consent: You have given us explicit consent for specific purposes (which you may withdraw at any time), including for the processing of any health-related data you choose to provide.
  • Pre-contractual and contractual necessity: When processing is necessary to take steps at your request before entering into a contract (such as preparing and sharing your travel quote) or to provide a service under a contract with you.
  • Legal obligation: When we are required to process your data by law.
  • Legitimate interest: When it does not override your privacy rights, such as marketing to existing clients.

6. DATA SHARING AND OUR LOCAL OPERATOR IN ARGENTINA

To design, quote and operate trips in Argentina and South America, Argentina Pura works with a local operating partner, Say Hueque Patagonia S.R.L., based in Buenos Aires, Argentina (the “Local Operator”).

When you submit an enquiry or request a quote, we share the personal data necessary with the Local Operator so that it can prepare your quote and, if you decide to proceed, organize and operate your trip. This sharing is based on taking steps at your request prior to a contract and/or on the performance of the services you contract, and, for any health-related data, on your explicit consent.

From the moment it receives your data, the Local Operator acts as an independent Data Controller with respect to its own processing for the quotation, sale and operation of your trip, under its own privacy policy and the applicable law (Argentine Law No. 25.326 and, where applicable, the GDPR).

Data you provide directly to the Local Operator. After your enquiry is transferred, the Local Operator may contact you directly and collect additional personal data from you (for example, during quotation, booking, or while you travel). Any personal data that you provide directly to the Local Operator is collected and processed by the Local Operator as an independent Data Controller, under its own privacy policy and its sole responsibility. Argentina Pura is not responsible for the processing of personal data that you provide directly to the Local Operator, nor for the Local Operator’s own processing activities.

We may also share your data with:

  • Service providers acting as Data Processors on our behalf (e.g., hosting, CRM, analytics and email providers), under a data processing agreement.
  • Providers necessary to fulfil your trip (e.g., airlines, transfer companies, hotels, excursion operators and insurers).
  • Public authorities where legally required.

We do not sell your personal data.

Third-party scheduling tool (Calendly)

Our website includes a scheduling tool provided by Calendly LLC (“Calendly”) and operated by our Local Operator (Say Hueque). If you book a call or meeting through it, the information you enter (such as name, email and the details you provide) is collected through Calendly and made available to the Local Operator, who acts as the Data Controller for that booking. Calendly processes this data as a service provider to the Local Operator and, in part, for its own purposes, as described in Calendly’s Privacy Notice (calendly.com/legal/privacy-notice). Calendly is based in the United States; international transfers rely on appropriate safeguards (EU-US Data Privacy Framework and/or Standard Contractual Clauses). This tool is loaded only after you accept non-essential cookies. Argentina Pura is not responsible for the Local Operator’s or Calendly’s processing of the data you submit through this tool.


7. INTERNATIONAL TRANSFERS

Sharing your data with the Local Operator involves a transfer to Argentina. The European Commission has recognized Argentina as a country ensuring an adequate level of data protection (Adequacy Decision 2003/490/EC), so this transfer is lawful without additional safeguards. Where any transfer is made to a country without an adequacy decision, we apply appropriate safeguards required by the GDPR, such as the European Commission’s Standard Contractual Clauses.


8. YOUR RIGHTS

You may exercise the following rights at any time:

  • Access your personal data (Art. 15 GDPR)
  • Rectify inaccurate or incomplete data (Art. 16 GDPR)
  • Erase your personal data (Art. 17 GDPR)
  • Restrict the processing (Art. 18 GDPR)
  • Data portability (Art. 20 GDPR)
  • Object to processing (Art. 21 GDPR)

If you have given consent for a specific purpose, you can withdraw it at any time without affecting the lawfulness of processing based on prior consent.

To exercise your rights, please send a reasoned and verified request to hola@argentinapura.com. If your request concerns data held by the Local Operator, we will forward it or direct you to the Local Operator, whose processing is under its own responsibility.

You also have the right to lodge a complaint with the competent Data Protection Authority (www.aepd.es) if you believe that the processing does not comply with current regulations.


9. LEGAL INFORMATION

This Privacy Policy complements, but does not override, any other applicable data protection law, which will prevail in case of conflict.

We may revise this Policy from time to time. If we make significant changes, we will notify you and request that you review and confirm acceptance of the latest version.
