Algemene voorwaarden voor het contracteren van toeristische diensten<\/p>

ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 verklaart expliciet:<\/p>

Iedereen die een van de diensten contracteert waarvan de technische organisatie werd uitgevoerd door Argentina Pura S.L. aanvaardt volledig deze algemene voorwaarden, die zullen worden beschouwd als automatisch opgenomen in het contract zonder de noodzaak van een schriftelijke transcriptie ervan op het contract.<\/p>

Jurisdictionele verordening<\/p>

De contractuele relatie tussen het organiserende agentschap en de klant wordt geregeld door Wet 301\/2002 \u201cDECRETO 301\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\u00fam. 150, de 21 de Diciembre de 2002)\u201d.\u201d<\/p>

Vergoedingen<\/p>

Vergoedingen worden uitgedrukt in Euro (EUR) of United States Dollars (U$). Ze omvatten de items die zijn gespecificeerd als \u201cinbegrepen\u201d op het Reserveringsformulier en op het Reisschema van de Klant, afgezien van de Belasting over de Toegevoegde Waarde (btw), tenzij anders vermeld. Visa, luchthaventaksen of andere inentingsbewijzen zijn niet inbegrepen, evenmin als andere diensten die niet als \u201cinbegrepen\u201d staan vermeld.<\/p>

Bij betaling in U$D is de wisselkoers de door de Europese Centrale Bank vastgestelde wisselkoers op de dag van betaling.<\/p>

De vergoedingen zijn geldig gedurende de per geval aangegeven periode. Na deze periode zijn ze niet meer geldig. Ze zijn onderhevig aan variatie zonder voorafgaande kennisgeving, wanneer de variatie van de kosten van de diensten een dergelijke variatie rechtvaardigen. Bovendien kan elke variatie van de tarieven leiden tot een herziening van de uiteindelijke prijsopgave van een Dienst. Deze variaties worden meegedeeld aan de klant - die de mogelijkheid heeft om de nieuwe voorwaarden van het contract te accepteren of om annulering van zijn reiscontract te vragen - in het geval dat de verhoging meer dan 15% van de totale prijs van het contract bedraagt - of hij kan het contract accepteren zoals gewijzigd.<\/p>

De tarieven kunnen niet meer worden gewijzigd vanaf 30 dagen voor de datum van de Dienst, als de behoefte aan diensten al is bevestigd.<\/p><\/div><\/div><\/div><\/div>

  • D\u00edas: Lunes a ViernesComienzo del ContratoEl contrato vinculante entre ARGENTINA PURA S.L. y el Cliente comienza a partir de la fecha en que ARGENTINA PURA S.L. recibe efectivamente el Formulario de Reserva con los datos personales completos del cliente por correo o tel\u00e9fono y el Dep\u00f3sito Inicial del Servicio a contratar. Su importe no podr\u00e1 ser inferior al 50% del valor total de la misma, salvo que -por causas especiales- se requiera otra suma adicional.A partir del momento en which el contrato vinculante entre ARGENTINA PURA S.L. es v\u00e1lido, el cliente acepta en su totalidad los t\u00e9rminos y condiciones generales aqu\u00ed descritos. Het contract is bindend tussen ARGENTINA PURA S.L. en alle klanten die voorkomen op het reserveringsformulier. De persoon die het reserveringsformulier opstelt, garandeert dat hij volledige vertegenwoordigingsbevoegdheid heeft voor elke andere persoon wiens naam voorkomt op het reserveringsformulier en bevestigt dat deze personen deze voorwaarden erkennen en aanvaarden. Op deze manier is de bevestiging van de dienst compleet. Vervoer per vliegtuig of over land

    Ook al worden de contracten voor het vervoer door de lucht of over land uitgevoerd door het Agentschap ARGENTINA PURA S.L., het gebruik ervan door de klanten impliceert een directe relatie tussen de klanten en deze transportbedrijven. Het Agentschap ARGENTINA PURA S.L. zal dus niet verantwoordelijk zijn voor enig ongemak dat voortvloeit uit de door hen geleverde diensten.<\/p>

    Wat betreft de vliegtickets - zodra de eerste aanbetaling is gedaan, worden de reserveringen uitgevoerd, maar de tickets worden niet uitgegeven. Als de klant zijn tickets wil laten uitgeven, moet hij het totale bedrag betalen - zo vermijdt hij ook een mogelijke verhoging van de ticketkosten.<\/p><\/li><\/ul><\/div><\/div><\/div><\/div>

    Betalingsvoorwaarden<\/p>

    Zoals vermeld in het vorige punt, opdat ARGENTINA PURA S.L. de Reservering van een Dienst kan bevestigen, dient een aanbetaling van niet minder dan 50% van het totale bedrag te worden gedaan. Het saldo zal worden betaald aan ARGENTINA PURA S.L. ten minste 15 dagen voor de datum waarop de Service zal worden verleend.<\/p>

    In het geval dat het saldo niet is betaald binnen deze datum, zal ARGENTINA PURA S.L. de reservering als geannuleerd beschouwen door de klant. In het geval van reserveringen die minder dan 15 dagen voor de vertrekdatum worden gemaakt, zal het volledige bedrag zonder uitstel worden gevraagd.<\/p>

    Wijzigingen door ARGENTINA PURA S.L.<\/p>

    Hoewel ons commercieel beleid erop gericht is om al onze klanten tevreden te stellen door de diensten uit te voeren zoals overeengekomen in het bindende contract, kunnen er bijzondere omstandigheden zijn die ons dwingen om de oorspronkelijke Reservering te wijzigen. Door zich te binden aan dit contract aanvaardt de klant dat het noodzakelijk kan zijn om de inhoud van de route te wijzigen als gevolg van lokale situaties. ARGENTINA PURA S.L. heeft het recht om geheel of gedeeltelijk het reisschema van de gecontracteerde diensten te wijzigen met inbegrip van vergoedingen, vluchten, accommodatie of andere diensten en deze te vervangen door alternatieve diensten van vergelijkbare waarde zonder enige compensatie, hetzij in geld of op welke andere manier dan ook.<\/p>

    Indien ARGENTINA PURA S.L. van mening is dat het noodzakelijk is om een substanti\u00eble wijziging aan te brengen zullen zij de klant zo spoedig mogelijk informeren over deze wijzigingen. De klant kan ervoor kiezen a) deze veranderingen te accepteren, b) deze diensten te vervangen door andere beschikbare diensten, op voorwaarde dat de kosten niet veranderen of dat de verschillen worden betaald, c) de gecontracteerde diensten te annuleren.<\/p>

    Annuleringen door ARGENTINA PURA S.L.<\/p>

    ARGENTINA PURA S.L. heeft het recht de oorspronkelijke Reservering geheel of gedeeltelijk te annuleren als gevolg van oorzaken buiten het bedrijf zoals: Geen opkomst van passagiers, elke gebeurtenis die tegen de persoonlijke \/groepsveiligheid kan zijn en tegen het normale verloop van de activiteit of activiteiten of als gevolg van een daad van God. In een dergelijk geval zal de klant geen terugbetaling van de betaalde kosten hebben.<\/p>

    Wijzigingen door klanten<\/p><\/div><\/div><\/div><\/div>

    Wijzigingen of aanpassingen van de oorspronkelijke Reservering kunnen niet worden gegarandeerd, want deze zijn afhankelijk van beschikbaarheid. Indien een passagier een oorspronkelijke Reservering wil wijzigen, zal de passagier die het Reserveringsformulier heeft ondertekend dit per e-mail of fax aangeven. Alle kosten die voortvloeien uit dergelijke wijzigingen zijn voor rekening van de Klant.<\/p>

    Annuleringen door klanten<\/p>

    Klanten kunnen op elk moment de Reservering annuleren, mits deze annulering schriftelijk - per e-mail of telefonisch - aan ARGENTINA PURA S.L. wordt meegedeeld. Vanaf de datum van ontvangst van de annulering zullen de volgende kosten in rekening worden gebracht:<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    In het geval dat ARGENTINA PURA S.L. wijzigingen heeft aangebracht in de oorspronkelijke Reservering van een gecontracteerde Dienst en de klant ervoor kiest deze te annuleren, zal ARGENTINA PURA S.L. het volledige bedrag betalen - mits de wijzigingen niet veroorzaakt zijn door overmacht.<\/p>

    In dergelijke gevallen ontvangt de Klant geen terugbetaling van het betaalde bedrag.<\/p><\/div><\/div><\/div><\/div>

    ARGENTINA PURA S.L. is niet verantwoordelijk voor welke kosten dan ook in het geval van een verandering -buiten zijn controle- van tijd of dag van vertrek van een tour, vlucht of ander vervoermiddel.<\/p>

    Daad van God betekent in dit document: \u201cEen gewelddadige en onverwachte gebeurtenis, buiten de menselijke wil om en daarom onvoorspelbaar en met onvermijdelijke gevolgen\u201d.<\/p>

    Voorbeelden: oorlogen, oorlogsdreiging, rellen, burgerlijke of industri\u00eble geschillen, terroristische activiteiten, natuur- of kernrampen, brand of ongunstige weersomstandigheden. Technische problemen bij het onderhoud van transportmiddelen, wijzigingen die voortvloeien uit het annuleren of herprogrammeren van vluchten van een luchtvaartmaatschappij, wijziging van de luchtvaartmaatschappij of van het type luchtschip of andere soortgelijke gebeurtenissen waarover ARGENTINA PURA S.L. geen controle heeft.<\/p>

    Wat betreft gedeeltelijke annuleringen, deze zullen per geval worden geanalyseerd en in het geval dat ze extra kosten met zich meebrengen, zullen deze worden betaald door de klant.<\/p>

    Documenten, visa en sanitaire vereisten.<\/p>

    De Klanten die een van onze Toeristische Diensten hebben gekocht en op het bindende contract staan, zijn verantwoordelijk voor de juistheid van hun documenten voor de toegang tot en het vrije verkeer in het te bezoeken land. Voorbeelden van deze documenten: identificatiedocumenten, paspoorten, visa, sanitaire documenten, enz.<\/p>

    In het geval dat, als gevolg van het ontbreken of het niet kunnen voorleggen van de benodigde documenten voor de reis, een klant vertraging oploopt of de reis geheel of gedeeltelijk annuleert of opgeeft, zal ARGENTINA PURA S.L. niet verantwoordelijk worden gehouden, in welk geval er geen terugbetaling zal plaatsvinden.<\/p>

    Minderjarigen -minder dan 18- moeten een door hun ouders ondertekend document voorleggen waarin zij toestemming geven om te reizen.<\/p>

    Ziekten en handicaps<\/p><\/div><\/div><\/div><\/div>

    Zodra het bindende contract tussen ARGENTINA PURA S.L. en de Klant is geformaliseerd dient de Klant ARGENTINA PURA S.L. te informeren indien hij een ziekte of handicap heeft of onder behandeling is voor een speciale conditie, fysiek of medisch. De Klant zal verantwoordelijk zijn voor alle noodzakelijke regelingen voor de levering van zijn medicijnen of andere behandelingen die nodig zouden kunnen zijn tijdens de reis of een van de inbegrepen diensten. Indien om welke reden dan ook de Klant ons niet op de hoogte heeft gebracht van deze feiten, voldoet hij niet aan de Reserveringsvoorwaarden, wat zal resulteren in zijn uitsluiting van de reis en het verlies van elk betaald bedrag.<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"

    General Conditions for contracting Tourist Services<\\\/p>

    ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 explicitly states:<\\\/p>

    Anyone contracting any of the services of which technical organization was carried out by Argentina Pura S.L totally accepts these general terms and conditions, which will be considered automatically incorporated to the contract with no need of a written transcription of them on the contract.<\\\/p>

    Jurisdictional Regulation<\\\/p>

    The contract relationship between the organizing Agency and the client will be ruled by Law 301\\\/2002 \\u201cDECRETO 301\\\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\\u00fam. 150, de 21 de Diciembre de 2002)\\u201d<\\\/p>

    Fees<\\\/p>

    Fees shall be expressed in Euro(EUR) or United States Dollars (U$). They include the \\u00edtems detailed as \\u201cincluded\\u201d at the Reservation Form and on the Client\\u2019s Itinerary apart from the Value Added Tax (VAT) unless otherwise stated. It does not include visas, airport taxes or other , vaccination certificates, nor any other services not specified as \\u201cincluded\\u201d.<\\\/p>

    In case payment is in U$D the exchange rate will be the exchange rate valid at the date of payment determined by the European Central Bank<\\\/p>

    The fees shall be valid during the time detailed in each case. Once this time is over, they will not be valid. They are subject to variation without any prior notice , when the variation of the costs of the services justify such variation. Moreover, any variation of the fees could cause a revision of the final quoting of a Service. These variations shall be notified to the client \\u2013 who will have the option of accepting the new conditions of the contract or ask for a cancellation of his travel contract \\u2013in case the increase is over 15% of the total price of the contract \\u2013 or he can accept the contract as modified.<\\\/p>

    No modification of the fees shall be possible as from 30 days prior to the date of the Service, when a requirement of services has already been confirmed.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Even though the contracting of air or land transport where carried out through the Agency ARGENTINA PURA S.L., the use of them by the clients implies a direct relationship between the clients and such transport companies . The Agency ARGENTINA PURA S.L. will thus not be responsible for any inconvenience arising from the services provided by them.<\\\/p>

      As regards the air tickets \\u2013 once the Initial Deposit is done \\u2013 the reservations are carried out but the tickets will not be issued. Should the client want to have his tickets issued, he shall pay for their total amount \\u2013 thus also avoiding any possible increase of the ticket fees.<\\\/p><\\\/li><\\\/ul><\\\/div><\\\/div><\\\/div><\\\/div>

      Payment Conditions<\\\/p>

      As mentioned on the previous \\u00edtem, in order for ARGENTINA PURA S.L. to confirm the Reservation of a service , a deposit of no less than 50% of its total amount shall be done. The balance shall be paid to ARGENTINA PURA S.L. at least 15 days prior to the date in which the Service shall be provided.<\\\/p>

      In case such balance was not paid within such date, ARGENTINA PURA S.L. will consider the reservation as canceled by the client. In the case of Reservations made with less than 15 days anticipation of the date of departure, the full amount will be required with no delay.<\\\/p>

      Changes by ARGENTINA PURA S.L.<\\\/p>

      Even though our commercial policies are aimed at satisfying each of our clients, carrying out services as arranged on the binding contract, there could exist special circumstances compelling us to alter the original Reservation. By binding himself to this contract the client accepts that it could be necessary to modify the content of the itinerary due to local situations. ARGENTINA PURA S.L. will have the right to partially or totally modify the itinerary of the services contracted including fees, flights, lodging or any other services and to substitute them for alternative services of similar value with no compensation whatsoever, either in money or any other way.<\\\/p>

      If ARGENTINA PURA S.L. judges it is necessary to make a substantial modification they shall inform the client as soon as possible about those changes. The client can choose a) to accept such changes, b)to change those services by other available services, provided they do not modify costs or they pay for the differences , c) to cancel the contracted services.<\\\/p>

      Cancellations by ARGENTINA PURA S.L.<\\\/p>

      ARGENTINA PURA S.L. has the right to partially or totally cancel the original Reservation due to causes beyond the company such as: No show of passengers, any event which might be against the personal \\\/group safety and act against the normal development of the activity or activities or due to an act of God. In any such case the client will not have a reimbursement of the paid fees.<\\\/p>

      Changes by Clients<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Changes or modifications to the original Reservation cannot be guaranteed for they are subject to availability . In case any passenger wanted to change an original Reservation, the passenger who signed the Reservation Form will state so by mail or fax. Any cost arising from such changes shall be paid by the Client.<\\\/p>

      Cancellations by Clients<\\\/p>

      Clients can cancel the Reservation at any moment, provided that such cancellation is communicated to ARGENTINA PURA S.L. in writing \\u2013 by email or phone.       In case ARGENTINA PURA S.L. had made changes to the original Reservation of a contracted Service and the client chose to cancel it, ARGENTINA PURA S.L. shall pay the full amount \\u2013 provided the changes were not caused by the Act of God.<\\\/p>

      In such cases the Client shall not receive reimbursement of the amount paid.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      ARGENTINA PURA S.L. is not responsible for any charge whatsoever in case of a change \\u2013beyond his control- of time or day of departure of a tour, flight or any other means of transport.<\\\/p>

      Act of God herein means : \\u201cA violent and unexpected event, beyond human will and for this reason unpredictable and of inevitable consequences\\u201d.<\\\/p>

      Examples: wars, war threats, riots, civil or industrial dispute, terrorist activities, natural or nuclear disasters , fire or adverse climatic conditions. Technical problems on problems of maintenance of means of transport, changes deriving from canceling or reprogramming of flights of an airline, alteration of the airline or of the type of airship or any other similar events beyond the control of ARGENTINA PURA S.L.<\\\/p>

      As regards partial cancellations they will be analyzed in each case, and in case they brought about additional charges they will be paid by the client.<\\\/p>

      Documents, visas and sanitary requirements.<\\\/p>

      The Clients who have bought any of our Tourist Services and appear on the binding contract are responsible for the correctness of their documents for entering and for free circulating within the country to be visited. Examples of these documents: identification documents , passports, visas, sanitary documents, etc.<\\\/p>

      In case that, due to lack or incorrection of the necessary documents for the trip, a client was delayed or should cancel or abandon the trip partially or totally , ARGENTINA PURA S.L. will not be held responsible, in which case there will be no reimbursement.<\\\/p>

      Underage -less than 18- shall submit a document signed by parents authorizing them to travel.<\\\/p>

      Diseases and Disabilities<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Once the binding contract between ARGENTINA PURA S.L. and the client is formalized the Client must inform ARGENTINA PURA S.L. if he has any disease or disability or he is on a treatment for any special condition either physical or medical. The Client will be responsible for all the necessary arrangements for the provision of his medicines or any other treatments that might be necessary during the trip or any of the services included.
