Condizioni generali di contratto per i servizi turistici<\/p>

ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 dichiara esplicitamente che:<\/p>

Chiunque contratta uno qualsiasi dei servizi la cui organizzazione tecnica \u00e8 stata realizzata da Argentina Pura S.L. accetta totalmente le presenti condizioni generali, che si considerano automaticamente incorporate al contratto senza necessit\u00e0 di trascriverle per iscritto sul contratto.<\/p>

Regolamento giurisdizionale<\/p>

Il rapporto contrattuale tra l'Agenzia organizzatrice e il cliente sar\u00e0 regolato dalla Legge 301\/2002 \"DECRETO 301\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\u00fam. 150, de 21 de Diciembre de 2002)\".<\/p>

Tasse<\/p>

Le tariffe sono espresse in euro (EUR) o in dollari statunitensi (U$). Comprendono gli elementi indicati come \"inclusi\" nel Modulo di prenotazione e nell'Itinerario del Cliente, oltre all'Imposta sul Valore Aggiunto (IVA), se non diversamente specificato. Non sono inclusi visti, tasse aeroportuali o altri certificati di vaccinazione, n\u00e9 altri servizi non specificati come \"inclusi\".<\/p>

In caso di pagamento in U$D, il tasso di cambio sar\u00e0 quello valido alla data del pagamento, determinato dalla Banca Centrale Europea.<\/p>

Le tariffe sono valide per il periodo di tempo indicato in ciascun caso. Una volta trascorso tale periodo, non saranno pi\u00f9 valide. Sono soggette a variazioni senza preavviso, quando la variazione dei costi dei servizi lo giustifichi. Inoltre, qualsiasi variazione delle tariffe potrebbe comportare una revisione del preventivo finale di un Servizio. Tali variazioni saranno notificate al cliente, che avr\u00e0 la possibilit\u00e0 di accettare le nuove condizioni del contratto o di chiedere l'annullamento del contratto di viaggio - nel caso in cui l'aumento sia superiore a 15% del prezzo totale del contratto - oppure potr\u00e0 accettare il contratto cos\u00ec come modificato.<\/p>

Non \u00e8 possibile modificare le tariffe a partire da 30 giorni prima della data del Servizio, quando \u00e8 gi\u00e0 stata confermata una richiesta di servizi.<\/p><\/div><\/div><\/div><\/div>

  • Giorni: Lunes a ViernesComizio del ContrattoIl contratto vincolante tra ARGENTINA PURA S.L. e il Cliente inizia a partire dalla data in cui ARGENTINA PURA S.L. riceve efficacemente il Formulario de Reserva con i dati personali completi del cliente per posta o telefono e il Deposito Iniziale del Servizio da contrattare. L'importo non pu\u00f2 essere inferiore al 50% del valore totale della stessa, salvo che -per cause particolari- sia richiesta un'altra somma aggiuntiva.A partire dal momento in cui il contratto vinculante tra ARGENTINA PURA S.L. \u00e8 valido, il cliente accetta nella sua totalit\u00e0 i termini e le condizioni generali qui descritti. Il contratto \u00e8 vincolante tra ARGENTINA PURA S.L. e tutti i clienti che compaiono nel Formulario di prenotazione. La persona che firma il Formulario de Reserva garantisce di possedere la piena autorit\u00e0 per rappresentare qualsiasi altra persona il cui nome compaia nel Formulario de Reserva e conferma che tutte queste persone lo riconoscono e accettano queste condizioni. In questo modo la conferma del servizio sar\u00e0 completa.Trasporto aereo o terrestre

    Anche se la contrattazione del trasporto aereo o terrestre viene effettuata tramite l'Agenzia ARGENTINA PURA S.L., l'utilizzo di queste ultime da parte dei clienti implica un rapporto diretto tra i clienti e tali societ\u00e0 di trasporto. L'Agenzia ARGENTINA PURA S.L. non sar\u00e0 pertanto responsabile di eventuali inconvenienti derivanti dai servizi da esse forniti.<\/p>

    Per quanto riguarda i biglietti aerei, una volta effettuato il Deposito Iniziale, le prenotazioni vengono effettuate ma i biglietti non vengono emessi. Nel caso in cui il cliente desideri l'emissione dei biglietti, dovr\u00e0 pagarne l'intero importo, evitando cos\u00ec anche un eventuale aumento delle tariffe dei biglietti.<\/p><\/li><\/ul><\/div><\/div><\/div><\/div>

    Condizioni di pagamento<\/p>

    Come indicato nel punto precedente, affinch\u00e9 ARGENTINA PURA S.L. confermi la Prenotazione di un servizio, \u00e8 necessario versare un deposito non inferiore a 50% dell'importo totale. Il saldo dovr\u00e0 essere versato ad ARGENTINA PURA S.L. almeno 15 giorni prima della data di prestazione del servizio.<\/p>

    In caso di mancato pagamento del saldo entro tale data, ARGENTINA PURA S.L. considerer\u00e0 la prenotazione come annullata dal cliente. Nel caso di prenotazioni effettuate con meno di 15 giorni di anticipo rispetto alla data di partenza, l'intero importo sar\u00e0 richiesto senza alcun ritardo.<\/p>

    Modifiche apportate da ARGENTINA PURA S.L.<\/p>

    Anche se le nostre politiche commerciali sono volte a soddisfare ogni cliente, eseguendo i servizi come concordati nel contratto vincolante, potrebbero esistere circostanze particolari che ci costringono a modificare la Prenotazione originale. Con l'adesione a questo contratto il cliente accetta che potrebbe essere necessario modificare il contenuto dell'itinerario a causa di situazioni locali. ARGENTINA PURA S.L. avr\u00e0 il diritto di modificare parzialmente o totalmente l'itinerario dei servizi contrattati, comprese le tariffe, i voli, l'alloggio o qualsiasi altro servizio e di sostituirli con servizi alternativi di valore analogo senza alcun tipo di compensazione, n\u00e9 in denaro n\u00e9 in altro modo.<\/p>

    Nel caso in cui ARGENTINA PURA S.L. ritenga necessario apportare una modifica sostanziale, informer\u00e0 il cliente il prima possibile di tali modifiche. Il cliente pu\u00f2 scegliere: a) di accettare tali modifiche; b) di cambiare tali servizi con altri servizi disponibili, a condizione che non modifichino i costi o che paghino le differenze; c) di annullare i servizi contrattuali.<\/p>

    Cancellazioni da parte di ARGENTINA PURA S.L.<\/p>

    ARGENTINA PURA S.L. ha il diritto di cancellare parzialmente o totalmente la Prenotazione originale per cause indipendenti dalla societ\u00e0 quali: Mancata presentazione dei passeggeri, qualsiasi evento che possa essere contrario alla sicurezza personale o del gruppo e che agisca contro il normale svolgimento dell'attivit\u00e0 o delle attivit\u00e0 o per cause di forza maggiore. In questo caso il cliente non avr\u00e0 diritto al rimborso delle quote versate.<\/p>

    Modifiche da parte dei clienti<\/p><\/div><\/div><\/div><\/div>

    I cambiamenti o le modifiche alla prenotazione originale non possono essere garantiti perch\u00e9 sono soggetti a disponibilit\u00e0. Nel caso in cui un passeggero desideri modificare una prenotazione originale, il passeggero che ha firmato il modulo di prenotazione lo dichiarer\u00e0 per posta o fax. Qualsiasi costo derivante da tali modifiche sar\u00e0 a carico del Cliente.<\/p>

    Cancellazioni da parte dei clienti<\/p>

    I clienti possono cancellare la Prenotazione in qualsiasi momento, a condizione che tale cancellazione sia comunicata ad ARGENTINA PURA S.L. per iscritto - via e-mail o per telefono. A partire dalla data di ricezione della comunicazione di cancellazione, verranno applicati i seguenti addebiti:<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    Nel caso in cui ARGENTINA PURA S.L. abbia apportato delle modifiche alla Prenotazione originale di un Servizio contrattato e il cliente scelga di annullarla, ARGENTINA PURA S.L. pagher\u00e0 l'intero importo - a condizione che le modifiche non siano state causate da cause di forza maggiore.<\/p>

    In questi casi il Cliente non ricever\u00e0 il rimborso dell'importo pagato.<\/p><\/div><\/div><\/div><\/div>

    ARGENTINA PURA S.L. non \u00e8 responsabile di alcun addebito in caso di cambiamento - al di fuori del suo controllo - dell'orario o del giorno di partenza di un tour, di un volo o di qualsiasi altro mezzo di trasporto.<\/p>

    Atto di Dio significa: \"Un evento violento e inaspettato, al di l\u00e0 della volont\u00e0 umana e per questo imprevedibile e dalle conseguenze inevitabili\".<\/p>

    Esempi: guerre, minacce di guerra, sommosse, controversie civili o industriali, attivit\u00e0 terroristiche, disastri naturali o nucleari, incendi o condizioni climatiche avverse. Problemi tecnici o di manutenzione dei mezzi di trasporto, modifiche derivanti dall'annullamento o dalla riprogrammazione dei voli di una compagnia aerea, alterazione della compagnia aerea o del tipo di dirigibile o qualsiasi altro evento simile al di fuori del controllo di ARGENTINA PURA S.L.<\/p>

    Per quanto riguarda le cancellazioni parziali, esse saranno analizzate di volta in volta e, nel caso in cui comportino spese aggiuntive, saranno a carico del cliente.<\/p>

    Documenti, visti e requisiti sanitari.<\/p>

    I Clienti che hanno acquistato uno dei nostri Servizi Turistici e che figurano nel contratto vincolante sono responsabili della correttezza dei loro documenti per l'ingresso e la libera circolazione nel Paese da visitare. Esempi di questi documenti: documenti d'identit\u00e0, passaporti, visti, documenti sanitari, ecc.<\/p>

    Nel caso in cui, a causa della mancanza o dell'incongruenza dei documenti necessari per il viaggio, un cliente subisca un ritardo o debba annullare o abbandonare il viaggio parzialmente o totalmente, ARGENTINA PURA S.L. non potr\u00e0 essere ritenuta responsabile, nel qual caso non vi sar\u00e0 alcun rimborso.<\/p>

    I minori di 18 anni devono presentare un documento firmato dai genitori che li autorizzi a viaggiare.<\/p>

    Malattie e disabilit\u00e0<\/p><\/div><\/div><\/div><\/div>

    Una volta formalizzato il contratto vincolante tra ARGENTINA PURA S.L. e il cliente, quest'ultimo dovr\u00e0 informare ARGENTINA PURA S.L. se \u00e8 affetto da malattie o disabilit\u00e0 o se sta seguendo un trattamento per qualsiasi condizione speciale, sia fisica che medica. Il Cliente sar\u00e0 responsabile di tutte le disposizioni necessarie per la fornitura dei suoi farmaci o di qualsiasi altro trattamento che potrebbe essere necessario durante il viaggio o uno qualsiasi dei servizi inclusi. Se per qualsiasi motivo il Cliente non ci informasse di uno di questi fatti, non rispetterebbe le condizioni di Prenotazione, il che comporterebbe la sua esclusione dal tour e la perdita di qualsiasi importo pagato.<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"

    General Conditions for contracting Tourist Services<\\\/p>

    ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 explicitly states:<\\\/p>

    Anyone contracting any of the services of which technical organization was carried out by Argentina Pura S.L totally accepts these general terms and conditions, which will be considered automatically incorporated to the contract with no need of a written transcription of them on the contract.<\\\/p>

    Jurisdictional Regulation<\\\/p>

    The contract relationship between the organizing Agency and the client will be ruled by Law 301\\\/2002 \\u201cDECRETO 301\\\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\\u00fam. 150, de 21 de Diciembre de 2002)\\u201d<\\\/p>

    Fees<\\\/p>

    Fees shall be expressed in Euro(EUR) or United States Dollars (U$). They include the \\u00edtems detailed as \\u201cincluded\\u201d at the Reservation Form and on the Client\\u2019s Itinerary apart from the Value Added Tax (VAT) unless otherwise stated. It does not include visas, airport taxes or other , vaccination certificates, nor any other services not specified as \\u201cincluded\\u201d.<\\\/p>

    In case payment is in U$D the exchange rate will be the exchange rate valid at the date of payment determined by the European Central Bank<\\\/p>

    The fees shall be valid during the time detailed in each case. Once this time is over, they will not be valid. They are subject to variation without any prior notice , when the variation of the costs of the services justify such variation. Moreover, any variation of the fees could cause a revision of the final quoting of a Service. These variations shall be notified to the client \\u2013 who will have the option of accepting the new conditions of the contract or ask for a cancellation of his travel contract \\u2013in case the increase is over 15% of the total price of the contract \\u2013 or he can accept the contract as modified.<\\\/p>

    No modification of the fees shall be possible as from 30 days prior to the date of the Service, when a requirement of services has already been confirmed.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Even though the contracting of air or land transport where carried out through the Agency ARGENTINA PURA S.L., the use of them by the clients implies a direct relationship between the clients and such transport companies . The Agency ARGENTINA PURA S.L. will thus not be responsible for any inconvenience arising from the services provided by them.<\\\/p>

      As regards the air tickets \\u2013 once the Initial Deposit is done \\u2013 the reservations are carried out but the tickets will not be issued. Should the client want to have his tickets issued, he shall pay for their total amount \\u2013 thus also avoiding any possible increase of the ticket fees.<\\\/p><\\\/li><\\\/ul><\\\/div><\\\/div><\\\/div><\\\/div>

      Payment Conditions<\\\/p>

      As mentioned on the previous \\u00edtem, in order for ARGENTINA PURA S.L. to confirm the Reservation of a service , a deposit of no less than 50% of its total amount shall be done. The balance shall be paid to ARGENTINA PURA S.L. at least 15 days prior to the date in which the Service shall be provided.<\\\/p>

      In case such balance was not paid within such date, ARGENTINA PURA S.L. will consider the reservation as canceled by the client. In the case of Reservations made with less than 15 days anticipation of the date of departure, the full amount will be required with no delay.<\\\/p>

      Changes by ARGENTINA PURA S.L.<\\\/p>

      Even though our commercial policies are aimed at satisfying each of our clients, carrying out services as arranged on the binding contract, there could exist special circumstances compelling us to alter the original Reservation. By binding himself to this contract the client accepts that it could be necessary to modify the content of the itinerary due to local situations. ARGENTINA PURA S.L. will have the right to partially or totally modify the itinerary of the services contracted including fees, flights, lodging or any other services and to substitute them for alternative services of similar value with no compensation whatsoever, either in money or any other way.<\\\/p>

      If ARGENTINA PURA S.L. judges it is necessary to make a substantial modification they shall inform the client as soon as possible about those changes. The client can choose a) to accept such changes, b)to change those services by other available services, provided they do not modify costs or they pay for the differences , c) to cancel the contracted services.<\\\/p>

      Cancellations by ARGENTINA PURA S.L.<\\\/p>

      ARGENTINA PURA S.L. has the right to partially or totally cancel the original Reservation due to causes beyond the company such as: No show of passengers, any event which might be against the personal \\\/group safety and act against the normal development of the activity or activities or due to an act of God. In any such case the client will not have a reimbursement of the paid fees.<\\\/p>

      Changes by Clients<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Changes or modifications to the original Reservation cannot be guaranteed for they are subject to availability . In case any passenger wanted to change an original Reservation, the passenger who signed the Reservation Form will state so by mail or fax. Any cost arising from such changes shall be paid by the Client.<\\\/p>

      Cancellations by Clients<\\\/p>

      Clients can cancel the Reservation at any moment, provided that such cancellation is communicated to ARGENTINA PURA S.L. in writing \\u2013 by email or phone.       In case ARGENTINA PURA S.L. had made changes to the original Reservation of a contracted Service and the client chose to cancel it, ARGENTINA PURA S.L. shall pay the full amount \\u2013 provided the changes were not caused by the Act of God.<\\\/p>

      In such cases the Client shall not receive reimbursement of the amount paid.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      ARGENTINA PURA S.L. is not responsible for any charge whatsoever in case of a change \\u2013beyond his control- of time or day of departure of a tour, flight or any other means of transport.<\\\/p>

      Act of God herein means : \\u201cA violent and unexpected event, beyond human will and for this reason unpredictable and of inevitable consequences\\u201d.<\\\/p>

      Examples: wars, war threats, riots, civil or industrial dispute, terrorist activities, natural or nuclear disasters , fire or adverse climatic conditions. Technical problems on problems of maintenance of means of transport, changes deriving from canceling or reprogramming of flights of an airline, alteration of the airline or of the type of airship or any other similar events beyond the control of ARGENTINA PURA S.L.<\\\/p>

      As regards partial cancellations they will be analyzed in each case, and in case they brought about additional charges they will be paid by the client.<\\\/p>

      Documents, visas and sanitary requirements.<\\\/p>

      The Clients who have bought any of our Tourist Services and appear on the binding contract are responsible for the correctness of their documents for entering and for free circulating within the country to be visited. Examples of these documents: identification documents , passports, visas, sanitary documents, etc.<\\\/p>

      In case that, due to lack or incorrection of the necessary documents for the trip, a client was delayed or should cancel or abandon the trip partially or totally , ARGENTINA PURA S.L. will not be held responsible, in which case there will be no reimbursement.<\\\/p>

      Underage -less than 18- shall submit a document signed by parents authorizing them to travel.<\\\/p>

      Diseases and Disabilities<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Once the binding contract between ARGENTINA PURA S.L. and the client is formalized the Client must inform ARGENTINA PURA S.L. if he has any disease or disability or he is on a treatment for any special condition either physical or medical. The Client will be responsible for all the necessary arrangements for the provision of his medicines or any other treatments that might be necessary during the trip or any of the services included.
