Conditions g\u00e9n\u00e9rales pour la passation de march\u00e9s de services touristiques<\/p>

ARGENTINA PURA S.L. - CIF : B67787275 - C.I.AN. 297593-3 indique explicitement :<\/p>

Toute personne contractant l'un des services dont l'organisation technique a \u00e9t\u00e9 r\u00e9alis\u00e9e par Argentina Pura S.L. accepte totalement les pr\u00e9sentes conditions g\u00e9n\u00e9rales, qui seront consid\u00e9r\u00e9es comme automatiquement incorpor\u00e9es au contrat sans qu'il soit n\u00e9cessaire de les transcrire par \u00e9crit sur le contrat.<\/p>

R\u00e8glement juridictionnel<\/p>

La relation contractuelle entre l'agence organisatrice et le client sera r\u00e9gie par la loi 301\/2002 \"DECRETO 301\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\u00fam. 150, de 21 de Diciembre de 2002)\"<\/p>

Droits d'inscription<\/p>

Les frais sont exprim\u00e9s en euros (EUR) ou en dollars des \u00c9tats-Unis (U$). Ils comprennent les \u00e9l\u00e9ments d\u00e9taill\u00e9s comme \"inclus\" dans le Formulaire de R\u00e9servation et sur l'Itin\u00e9raire du Client, \u00e0 l'exception de la Taxe sur la Valeur Ajout\u00e9e (TVA), sauf indication contraire. Ils ne comprennent pas les visas, les taxes d'a\u00e9roport ou autres, les certificats de vaccination, ni tout autre service non sp\u00e9cifi\u00e9 comme \"inclus\".<\/p>

En cas de paiement en U$D, le taux de change sera le taux de change en vigueur \u00e0 la date du paiement, d\u00e9termin\u00e9 par la Banque centrale europ\u00e9enne.<\/p>

Les redevances sont valables pendant la p\u00e9riode indiqu\u00e9e dans chaque cas. Pass\u00e9 ce d\u00e9lai, ils ne seront plus valables. Ils sont susceptibles d'\u00eatre modifi\u00e9s sans pr\u00e9avis, lorsque la variation des co\u00fbts des services le justifie. En outre, toute variation des frais peut entra\u00eener une r\u00e9vision du devis final d'un service. Ces variations seront notifi\u00e9es au client - qui aura la possibilit\u00e9 d'accepter les nouvelles conditions du contrat ou de demander l'annulation de son contrat de voyage - dans le cas o\u00f9 l'augmentation est sup\u00e9rieure \u00e0 15% du prix total du contrat - ou il peut accepter le contrat tel qu'il a \u00e9t\u00e9 modifi\u00e9.<\/p>

Aucune modification des tarifs n'est possible \u00e0 partir de 30 jours avant la date de la prestation, lorsqu'un besoin de services a d\u00e9j\u00e0 \u00e9t\u00e9 confirm\u00e9.<\/p><\/div><\/div><\/div><\/div>

  • \u25cf D\u00edas : Lunes a ViernesComienzo del ContratoEl contrato vinculante entre ARGENTINA PURA S.L. et el Cliente comienza a partir de la fecha en que ARGENTINA PURA S.L. recibe efectivamente el Formulario de Reserva con los datos personales completos del cliente por correo o tel\u00e9fono y el Dep\u00f3sito Inicial del Servicio a contratar. Le montant ne peut \u00eatre inf\u00e9rieur \u00e0 50% de la valeur totale du contrat, sauf si, pour des raisons particuli\u00e8res, une autre somme est n\u00e9cessaire. \u00c0 partir du moment o\u00f9 le contrat entre ARGENTINA PURA S.L. est sign\u00e9, le client accepte dans sa totalit\u00e9 les termes et conditions g\u00e9n\u00e9rales d\u00e9crits ci-dessous. Le contrat est conclu entre ARGENTINA PURA S.L. et tous les clients figurant sur le formulaire de r\u00e9servation. La personne qui remplit le formulaire de r\u00e9servation garantit qu'elle dispose de l'autorit\u00e9 n\u00e9cessaire pour repr\u00e9senter toute autre personne dont le nom figure dans le formulaire de r\u00e9servation et confirme que toutes ces personnes reconnaissent et acceptent ces conditions. De cette mani\u00e8re, la confirmation du service sera compl\u00e8te.Transporte A\u00e9reo o Terrestre

    Bien que les contrats de transport a\u00e9rien ou terrestre soient r\u00e9alis\u00e9s par l'interm\u00e9diaire de l'Agence ARGENTINA PURA S.L., leur utilisation par les clients implique une relation directe entre les clients et les entreprises de transport. L'Agence ARGENTINA PURA S.L. ne sera donc pas responsable de tout inconv\u00e9nient d\u00e9coulant des services fournis par ces derni\u00e8res.<\/p>

    En ce qui concerne les billets d'avion, une fois le d\u00e9p\u00f4t initial effectu\u00e9, les r\u00e9servations sont effectu\u00e9es mais les billets ne sont pas \u00e9mis. Si le client souhaite que ses billets soient \u00e9mis, il doit en payer le montant total, ce qui lui permet d'\u00e9viter une \u00e9ventuelle augmentation du prix des billets.<\/p><\/li><\/ul><\/div><\/div><\/div><\/div>

    Conditions de paiement<\/p>

    Comme mentionn\u00e9 dans l'article pr\u00e9c\u00e9dent, pour que ARGENTINA PURA S.L. puisse confirmer la r\u00e9servation d'un service, un acompte d'au moins 50% du montant total devra \u00eatre vers\u00e9. Le solde devra \u00eatre pay\u00e9 \u00e0 ARGENTINA PURA S.L. au moins 15 jours avant la date de prestation du service.<\/p>

    Dans le cas o\u00f9 ce solde n'a pas \u00e9t\u00e9 pay\u00e9 dans ce d\u00e9lai, ARGENTINA PURA S.L. consid\u00e9rera la r\u00e9servation comme annul\u00e9e par le client. Dans le cas de R\u00e9servations effectu\u00e9es avec moins de 15 jours d'anticipation de la date de d\u00e9part, le montant total sera exig\u00e9 sans d\u00e9lai.<\/p>

    Modifications apport\u00e9es par ARGENTINA PURA S.L.<\/p>

    Bien que notre politique commerciale vise \u00e0 satisfaire chacun de nos clients, en r\u00e9alisant les services tels qu'ils sont pr\u00e9vus dans le contrat, il peut exister des circonstances particuli\u00e8res qui nous obligent \u00e0 modifier la r\u00e9servation initiale. En se liant \u00e0 ce contrat, le client accepte qu'il puisse \u00eatre n\u00e9cessaire de modifier le contenu de l'itin\u00e9raire en raison de situations locales. ARGENTINA PURA S.L. aura le droit de modifier partiellement ou totalement l'itin\u00e9raire des services contract\u00e9s, y compris les frais, les vols, le logement ou tout autre service, et de les remplacer par des services alternatifs de valeur similaire, sans aucune compensation, que ce soit en argent ou de toute autre mani\u00e8re.<\/p>

    Si ARGENTINA PURA S.L. estime qu'il est n\u00e9cessaire d'effectuer une modification substantielle, elle en informera le client le plus rapidement possible. Le client peut choisir a) d'accepter ces changements, b) de remplacer ces services par d'autres services disponibles, \u00e0 condition qu'ils ne modifient pas les co\u00fbts ou qu'ils paient les diff\u00e9rences, c) d'annuler les services contract\u00e9s.<\/p>

    Annulations par ARGENTINA PURA S.L.<\/p>

    ARGENTINA PURA S.L. se r\u00e9serve le droit d'annuler partiellement ou totalement la r\u00e9servation initiale pour des raisons ind\u00e9pendantes de sa volont\u00e9 telles que : Non pr\u00e9sentation des passagers, tout \u00e9v\u00e9nement qui pourrait \u00eatre contre la s\u00e9curit\u00e9 des personnes\/groupes et agir contre le d\u00e9veloppement normal de l'activit\u00e9 ou des activit\u00e9s ou en raison d'un cas de force majeure. Dans ce cas, le client n'aura pas droit au remboursement des frais pay\u00e9s.<\/p>

    Changements par les clients<\/p><\/div><\/div><\/div><\/div>

    Les changements ou modifications de la r\u00e9servation originale ne peuvent \u00eatre garantis car ils sont soumis \u00e0 la disponibilit\u00e9. Au cas o\u00f9 un passager souhaiterait modifier une R\u00e9servation originale, le passager qui a sign\u00e9 le Formulaire de r\u00e9servation l'indiquera par courrier ou par fax. Tous les frais r\u00e9sultant de ces modifications seront \u00e0 la charge du client.<\/p>

    Annulations par les clients<\/p>

    Les clients peuvent annuler la r\u00e9servation \u00e0 tout moment, \u00e0 condition que cette annulation soit communiqu\u00e9e \u00e0 ARGENTINA PURA S.L. par \u00e9crit - par courrier \u00e9lectronique ou par t\u00e9l\u00e9phone. A partir de la date de r\u00e9ception de la notification d'annulation, les frais suivants seront appliqu\u00e9s :<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    Si ARGENTINA PURA S.L. a apport\u00e9 des modifications \u00e0 la r\u00e9servation initiale d'un service contract\u00e9 et que le client d\u00e9cide de l'annuler, ARGENTINA PURA S.L. paiera le montant total, \u00e0 condition que les modifications n'aient pas \u00e9t\u00e9 caus\u00e9es par un cas de force majeure.<\/p>

    Dans ce cas, le client ne recevra pas le remboursement du montant pay\u00e9.<\/p><\/div><\/div><\/div><\/div>

    ARGENTINA PURA S.L. n'est pas responsable de quelque frais que ce soit en cas de changement - ind\u00e9pendant de sa volont\u00e9 - de l'heure ou du jour de d\u00e9part d'un circuit, d'un vol ou de tout autre moyen de transport.<\/p>

    Le terme \"acte de Dieu\" signifie : \"Un \u00e9v\u00e9nement violent et inattendu, ind\u00e9pendant de la volont\u00e9 humaine et, pour cette raison, impr\u00e9visible et aux cons\u00e9quences in\u00e9vitables\".<\/p>

    Exemples : guerres, menaces de guerre, \u00e9meutes, conflits civils ou industriels, activit\u00e9s terroristes, catastrophes naturelles ou nucl\u00e9aires, incendies ou conditions climatiques d\u00e9favorables. Probl\u00e8mes techniques ou de maintenance des moyens de transport, changements d\u00e9coulant de l'annulation ou de la reprogrammation des vols d'une compagnie a\u00e9rienne, modification de la compagnie a\u00e9rienne ou du type de dirigeable ou tout autre \u00e9v\u00e9nement similaire \u00e9chappant au contr\u00f4le d'ARGENTINA PURA S.L.<\/p>

    En ce qui concerne les annulations partielles, elles seront analys\u00e9es dans chaque cas, et si elles entra\u00eenent des frais suppl\u00e9mentaires, ils seront pay\u00e9s par le client.<\/p>

    Documents, visas et exigences sanitaires.<\/p>

    Les clients qui ont achet\u00e9 l'un de nos services touristiques et qui figurent sur le contrat obligatoire sont responsables de l'exactitude de leurs documents pour l'entr\u00e9e et la libre circulation dans le pays \u00e0 visiter. Exemples de ces documents : pi\u00e8ces d'identit\u00e9, passeports, visas, documents sanitaires, etc.<\/p>

    Dans le cas o\u00f9, \u00e0 cause du manque ou de l'incorrection des documents n\u00e9cessaires pour le voyage, un client serait retard\u00e9 ou devrait annuler ou abandonner le voyage partiellement ou totalement, ARGENTINA PURA S.L. ne sera pas tenu responsable, dans ce cas il n'y aura pas de remboursement.<\/p>

    Les mineurs - moins de 18 ans - doivent pr\u00e9senter un document sign\u00e9 par leurs parents les autorisant \u00e0 voyager.<\/p>

    Maladies et handicaps<\/p><\/div><\/div><\/div><\/div>

    Une fois que le contrat entre ARGENTINA PURA S.L. et le client est formalis\u00e9, le client doit informer ARGENTINA PURA S.L. s'il souffre d'une maladie ou d'un handicap ou s'il suit un traitement pour une condition sp\u00e9ciale, physique ou m\u00e9dicale. Le client sera responsable de toutes les dispositions n\u00e9cessaires pour la fourniture de ses m\u00e9dicaments ou de tout autre traitement qui pourrait \u00eatre n\u00e9cessaire pendant le voyage ou l'un des services inclus.     General Conditions for contracting Tourist Services<\\\/p>

    ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 explicitly states:<\\\/p>

    Anyone contracting any of the services of which technical organization was carried out by Argentina Pura S.L totally accepts these general terms and conditions, which will be considered automatically incorporated to the contract with no need of a written transcription of them on the contract.<\\\/p>

    Jurisdictional Regulation<\\\/p>

    The contract relationship between the organizing Agency and the client will be ruled by Law 301\\\/2002 \\u201cDECRETO 301\\\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\\u00fam. 150, de 21 de Diciembre de 2002)\\u201d<\\\/p>

    Fees<\\\/p>

    Fees shall be expressed in Euro(EUR) or United States Dollars (U$). They include the \\u00edtems detailed as \\u201cincluded\\u201d at the Reservation Form and on the Client\\u2019s Itinerary apart from the Value Added Tax (VAT) unless otherwise stated. It does not include visas, airport taxes or other , vaccination certificates, nor any other services not specified as \\u201cincluded\\u201d.<\\\/p>

    In case payment is in U$D the exchange rate will be the exchange rate valid at the date of payment determined by the European Central Bank<\\\/p>

    The fees shall be valid during the time detailed in each case. Once this time is over, they will not be valid. They are subject to variation without any prior notice , when the variation of the costs of the services justify such variation. Moreover, any variation of the fees could cause a revision of the final quoting of a Service. These variations shall be notified to the client \\u2013 who will have the option of accepting the new conditions of the contract or ask for a cancellation of his travel contract \\u2013in case the increase is over 15% of the total price of the contract \\u2013 or he can accept the contract as modified.<\\\/p>

    No modification of the fees shall be possible as from 30 days prior to the date of the Service, when a requirement of services has already been confirmed.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Even though the contracting of air or land transport where carried out through the Agency ARGENTINA PURA S.L., the use of them by the clients implies a direct relationship between the clients and such transport companies . The Agency ARGENTINA PURA S.L. will thus not be responsible for any inconvenience arising from the services provided by them.<\\\/p>

      As regards the air tickets \\u2013 once the Initial Deposit is done \\u2013 the reservations are carried out but the tickets will not be issued. Should the client want to have his tickets issued, he shall pay for their total amount \\u2013 thus also avoiding any possible increase of the ticket fees.<\\\/p><\\\/li><\\\/ul><\\\/div><\\\/div><\\\/div><\\\/div>

      Payment Conditions<\\\/p>

      As mentioned on the previous \\u00edtem, in order for ARGENTINA PURA S.L. to confirm the Reservation of a service , a deposit of no less than 50% of its total amount shall be done. The balance shall be paid to ARGENTINA PURA S.L. at least 15 days prior to the date in which the Service shall be provided.<\\\/p>

      In case such balance was not paid within such date, ARGENTINA PURA S.L. will consider the reservation as canceled by the client. In the case of Reservations made with less than 15 days anticipation of the date of departure, the full amount will be required with no delay.<\\\/p>

      Changes by ARGENTINA PURA S.L.<\\\/p>

      Even though our commercial policies are aimed at satisfying each of our clients, carrying out services as arranged on the binding contract, there could exist special circumstances compelling us to alter the original Reservation. By binding himself to this contract the client accepts that it could be necessary to modify the content of the itinerary due to local situations. ARGENTINA PURA S.L. will have the right to partially or totally modify the itinerary of the services contracted including fees, flights, lodging or any other services and to substitute them for alternative services of similar value with no compensation whatsoever, either in money or any other way.<\\\/p>

      If ARGENTINA PURA S.L. judges it is necessary to make a substantial modification they shall inform the client as soon as possible about those changes. The client can choose a) to accept such changes, b)to change those services by other available services, provided they do not modify costs or they pay for the differences , c) to cancel the contracted services.<\\\/p>

      Cancellations by ARGENTINA PURA S.L.<\\\/p>

      ARGENTINA PURA S.L. has the right to partially or totally cancel the original Reservation due to causes beyond the company such as: No show of passengers, any event which might be against the personal \\\/group safety and act against the normal development of the activity or activities or due to an act of God. In any such case the client will not have a reimbursement of the paid fees.<\\\/p>

      Changes by Clients<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Changes or modifications to the original Reservation cannot be guaranteed for they are subject to availability . In case any passenger wanted to change an original Reservation, the passenger who signed the Reservation Form will state so by mail or fax. Any cost arising from such changes shall be paid by the Client.<\\\/p>

      Cancellations by Clients<\\\/p>

      Clients can cancel the Reservation at any moment, provided that such cancellation is communicated to ARGENTINA PURA S.L. in writing \\u2013 by email or phone.       In case ARGENTINA PURA S.L. had made changes to the original Reservation of a contracted Service and the client chose to cancel it, ARGENTINA PURA S.L. shall pay the full amount \\u2013 provided the changes were not caused by the Act of God.<\\\/p>

      In such cases the Client shall not receive reimbursement of the amount paid.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      ARGENTINA PURA S.L. is not responsible for any charge whatsoever in case of a change \\u2013beyond his control- of time or day of departure of a tour, flight or any other means of transport.<\\\/p>

      Act of God herein means : \\u201cA violent and unexpected event, beyond human will and for this reason unpredictable and of inevitable consequences\\u201d.<\\\/p>

      Examples: wars, war threats, riots, civil or industrial dispute, terrorist activities, natural or nuclear disasters , fire or adverse climatic conditions. Technical problems on problems of maintenance of means of transport, changes deriving from canceling or reprogramming of flights of an airline, alteration of the airline or of the type of airship or any other similar events beyond the control of ARGENTINA PURA S.L.<\\\/p>

      As regards partial cancellations they will be analyzed in each case, and in case they brought about additional charges they will be paid by the client.<\\\/p>

      Documents, visas and sanitary requirements.<\\\/p>

      The Clients who have bought any of our Tourist Services and appear on the binding contract are responsible for the correctness of their documents for entering and for free circulating within the country to be visited. Examples of these documents: identification documents , passports, visas, sanitary documents, etc.<\\\/p>

      In case that, due to lack or incorrection of the necessary documents for the trip, a client was delayed or should cancel or abandon the trip partially or totally , ARGENTINA PURA S.L. will not be held responsible, in which case there will be no reimbursement.<\\\/p>

      Underage -less than 18- shall submit a document signed by parents authorizing them to travel.<\\\/p>

      Diseases and Disabilities<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Once the binding contract between ARGENTINA PURA S.L. and the client is formalized the Client must inform ARGENTINA PURA S.L. if he has any disease or disability or he is on a treatment for any special condition either physical or medical. The Client will be responsible for all the necessary arrangements for the provision of his medicines or any other treatments that might be necessary during the trip or any of the services included.
