Condiciones generales de contrataci\u00f3n de servicios tur\u00edsticos<\/p>

ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 declara expl\u00edcitamente:<\/p>

Toda persona que contrate cualquiera de los servicios cuya organizaci\u00f3n t\u00e9cnica haya sido llevada a cabo por Argentina Pura S.L. acepta plenamente las presentes condiciones generales, que se considerar\u00e1n autom\u00e1ticamente incorporadas al contrato sin necesidad de transcripci\u00f3n escrita de las mismas en el contrato.<\/p>

Regulaci\u00f3n jurisdiccional<\/p>

La relaci\u00f3n contractual entre la Agencia organizadora y el cliente se regir\u00e1 por la Ley 301\/2002 \"DECRETO 301\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\u00fam. 150, de 21 de Diciembre de 2002)\"<\/p>

Tasas<\/p>

Las tarifas se expresar\u00e1n en euros (EUR) o en d\u00f3lares estadounidenses (U$). Incluyen los \u00edtems detallados como \"incluidos\" en el Formulario de Reserva y en el Itinerario del Cliente, adem\u00e1s del Impuesto sobre el Valor A\u00f1adido (IVA), salvo que se indique lo contrario. No incluye visados, tasas aeroportuarias u otros , certificados de vacunaci\u00f3n, ni cualquier otro servicio no especificado como \"incluido\".<\/p>

En caso de pago en U$D, el tipo de cambio ser\u00e1 el tipo de cambio v\u00e1lido en la fecha de pago determinado por el Banco Central Europeo.<\/p>

Las tasas ser\u00e1n v\u00e1lidas durante el tiempo detallado en cada caso. Una vez transcurrido este tiempo, no tendr\u00e1n validez. Est\u00e1n sujetas a variaci\u00f3n sin previo aviso , cuando la variaci\u00f3n de los costes de los servicios justifique dicha variaci\u00f3n. Asimismo, cualquier variaci\u00f3n de los honorarios podr\u00e1 dar lugar a la revisi\u00f3n del presupuesto final de un Servicio. Estas variaciones ser\u00e1n notificadas al cliente - que tendr\u00e1 la opci\u00f3n de aceptar las nuevas condiciones del contrato o solicitar la anulaci\u00f3n de su contrato de viaje - en caso de que el incremento sea superior a 15% del precio total del contrato - o podr\u00e1 aceptar el contrato tal y como ha sido modificado.<\/p>

No ser\u00e1 posible ninguna modificaci\u00f3n de las tarifas a partir de 30 d\u00edas antes de la fecha del Servicio, cuando ya se haya confirmado un requerimiento de servicios.<\/p><\/div><\/div><\/div><\/div>

  • \u25cf D\u00edas: Lunes a ViernesComienzo del ContratoEl contrato vinculante entre ARGENTINA PURA S.L. y el Cliente comienza a partir de la fecha en que ARGENTINA PURA S.L. recibe efectivamente el Formulario de Reserva con los datos personales completos del cliente por correo o tel\u00e9fono y el Dep\u00f3sito Inicial del Servicio a contratar. Su importe no podr\u00e1 ser inferior al 50% del valor total de la misma, salvo que -por causas especiales- se requiera otra suma adicional.A partir del momento en que el contrato vinculante entre ARGENTINA PURA S.L. es v\u00e1lido, el cliente acepta en su totalidad los t\u00e9rminos y condiciones generales aqu\u00ed descritos. El contrato es vinculante entre ARGENTINA PURA S.L. y todos los clientes que aparecen en el Formulario de Reserva. La persona que firma el Formulario de Reserva garantiza que posee plena autoridad para representar a cualquier otra persona cuyo nombre aparezca en el Formulario de Reserva y confirma que todas esas personas lo reconocen y aceptan dichas condiciones. De esta forma la Confirmaci\u00f3n del Servicio quedar\u00e1 completa.Transporte A\u00e9reo o Terrestre

    Si bien la contrataci\u00f3n del transporte a\u00e9reo o terrestre se realiza a trav\u00e9s de la Agencia ARGENTINA PURA S.L., la utilizaci\u00f3n de los mismos por parte de los clientes implica una relaci\u00f3n directa entre los clientes y dichas empresas de transporte. Por lo tanto, la Agencia ARGENTINA PURA S.L. no ser\u00e1 responsable por ning\u00fan inconveniente derivado de los servicios prestados por las mismas.<\/p>

    En cuanto a los billetes de avi\u00f3n, una vez efectuado el dep\u00f3sito inicial, las reservas se llevan a cabo, pero no se emiten los billetes. Si el cliente desea que se emitan sus billetes, deber\u00e1 abonar el importe total de los mismos, evitando as\u00ed cualquier posible aumento de las tasas de emisi\u00f3n.<\/p><\/li><\/ul><\/div><\/div><\/div><\/div>

    Condiciones de pago<\/p>

    Tal como se menciona en el \u00edtem anterior, para que ARGENTINA PURA S.L. confirme la Reserva de un servicio, deber\u00e1 efectuarse un dep\u00f3sito no inferior a 50% del monto total del mismo. El saldo deber\u00e1 ser abonado a ARGENTINA PURA S.L. por lo menos 15 d\u00edas antes de la fecha en que se prestar\u00e1 el Servicio.<\/p>

    En caso de que dicho saldo no fuera abonado dentro de dicha fecha, ARGENTINA PURA S.L. considerar\u00e1 la reserva como cancelada por el cliente. En el caso de Reservas efectuadas con menos de 15 d\u00edas de anticipaci\u00f3n a la fecha de salida, se exigir\u00e1 el importe total sin demora.<\/p>

    Cambios por ARGENTINA PURA S.L.<\/p>

    Si bien nuestras pol\u00edticas comerciales est\u00e1n orientadas a satisfacer a cada uno de nuestros clientes, llevando a cabo los servicios seg\u00fan lo dispuesto en el contrato vinculante, podr\u00edan existir circunstancias especiales que nos obliguen a alterar la Reserva original. Al vincularse a este contrato el cliente acepta que podr\u00eda ser necesario modificar el contenido del itinerario debido a situaciones locales. ARGENTINA PURA S.L. tendr\u00e1 derecho a modificar parcial o totalmente el itinerario de los servicios contratados incluyendo tarifas, vuelos, alojamiento o cualquier otro servicio y a sustituirlos por servicios alternativos de similar valor sin compensaci\u00f3n alguna, ni en dinero ni de ninguna otra forma.<\/p>

    Si ARGENTINA PURA S.L. juzgara necesario realizar una modificaci\u00f3n sustancial deber\u00e1 informar al cliente a la brevedad sobre dichos cambios. El cliente podr\u00e1 optar por a) aceptar dichos cambios, b) cambiar dichos servicios por otros disponibles, siempre que no modifiquen costos o abone las diferencias, c) rescindir los servicios contratados.<\/p>

    Cancelaciones por parte de ARGENTINA PURA S.L.<\/p>

    ARGENTINA PURA S.L. se reserva el derecho de cancelar parcial o totalmente la Reserva original por causas ajenas a la empresa tales como: No presentaci\u00f3n de pasajeros, cualquier evento que atente contra la seguridad personal\/grupal y act\u00fae en contra del normal desarrollo de la o las actividades o por caso fortuito. En cualquiera de estos casos el cliente no tendr\u00e1 reembolso de las cuotas pagadas.<\/p>

    Cambios de los clientes<\/p><\/div><\/div><\/div><\/div>

    Los cambios o modificaciones de la Reserva original no pueden garantizarse ya que est\u00e1n sujetos a disponibilidad. En caso de que alg\u00fan pasajero quisiera cambiar una Reserva original, el pasajero que firm\u00f3 el Formulario de Reserva lo indicar\u00e1 por correo o fax. Cualquier coste derivado de dichos cambios correr\u00e1 a cargo del Cliente.<\/p>

    Cancelaciones de clientes<\/p>

    Los Clientes podr\u00e1n cancelar la Reserva en cualquier momento, siempre que dicha cancelaci\u00f3n sea comunicada a ARGENTINA PURA S.L. por escrito - por correo electr\u00f3nico o por tel\u00e9fono. A partir de la fecha de recepci\u00f3n de la comunicaci\u00f3n de cancelaci\u00f3n, se aplicar\u00e1n los siguientes cargos:<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    En caso de que ARGENTINA PURA S.L. hubiera realizado cambios en la Reserva original de un Servicio contratado y el cliente optara por cancelarla, ARGENTINA PURA S.L. abonar\u00e1 el importe \u00edntegro -siempre que los cambios no hayan sido causados por caso fortuito-.<\/p>

    En tales casos, el Cliente no recibir\u00e1 el reembolso del importe abonado.<\/p><\/div><\/div><\/div><\/div>

    ARGENTINA PURA S.L. no se responsabiliza por cargo alguno en caso de cambio -fuera de su control- de hora o d\u00eda de salida de un tour, vuelo o cualquier otro medio de transporte.<\/p>

    Acto de Dios significa aqu\u00ed : \"Acontecimiento violento e inesperado, ajeno a la voluntad humana y por ello imprevisible y de consecuencias inevitables\".<\/p>

    Ejemplos: guerras, amenazas de guerra, disturbios, conflictos civiles o laborales, actividades terroristas, cat\u00e1strofes naturales o nucleares , incendios o condiciones clim\u00e1ticas adversas. Problemas t\u00e9cnicos sobre problemas de mantenimiento de medios de transporte, cambios derivados de la cancelaci\u00f3n o reprogramaci\u00f3n de vuelos de una compa\u00f1\u00eda a\u00e9rea, alteraci\u00f3n de la compa\u00f1\u00eda a\u00e9rea o del tipo de aeronave o cualquier otro evento similar fuera del control de ARGENTINA PURA S.L.<\/p>

    En cuanto a las cancelaciones parciales ser\u00e1n analizadas en cada caso, y en caso de que trajeran consigo cargos adicionales ser\u00e1n abonados por el cliente.<\/p>

    Documentos, visados y requisitos sanitarios.<\/p>

    Los Clientes que hayan comprado alguno de nuestros Servicios Tur\u00edsticos y figuren en el contrato vinculante son responsables de la correcci\u00f3n de sus documentos para entrar y circular libremente por el pa\u00eds a visitar. Ejemplos de estos documentos: documentos de identificaci\u00f3n, pasaportes, visados, documentos sanitarios, etc.<\/p>

    En caso de que, por falta o incorrecci\u00f3n de los documentos necesarios para el viaje, un cliente se retrasara o debiera cancelar o abandonar parcial o totalmente el viaje, ARGENTINA PURA S.L. no ser\u00e1 responsable, en cuyo caso no habr\u00e1 lugar a reembolso alguno.<\/p>

    Los menores de edad -menores de 18 a\u00f1os- deber\u00e1n presentar un documento firmado por los padres que les autorice a viajar.<\/p>

    Enfermedades y discapacidades<\/p><\/div><\/div><\/div><\/div>

    Una vez formalizado el contrato vinculante entre ARGENTINA PURA S.L. y el cliente el Cliente deber\u00e1 informar a ARGENTINA PURA S.L. si padece alguna enfermedad o discapacidad o se encuentra en tratamiento por alguna condici\u00f3n especial ya sea f\u00edsica o m\u00e9dica. El Cliente ser\u00e1 responsable de todos los arreglos necesarios para la provisi\u00f3n de sus medicamentos o cualquier otro tratamiento que pudiera ser necesario durante el viaje o cualquiera de los servicios incluidos. Si por cualquier motivo el Cliente no nos informara de cualquiera de estos hechos, estar\u00eda incumpliendo las condiciones de Reserva, lo que supondr\u00e1 su exclusi\u00f3n del viaje, y la p\u00e9rdida de cualquier cantidad abonada.<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"

    General Conditions for contracting Tourist Services<\\\/p>

    ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 explicitly states:<\\\/p>

    Anyone contracting any of the services of which technical organization was carried out by Argentina Pura S.L totally accepts these general terms and conditions, which will be considered automatically incorporated to the contract with no need of a written transcription of them on the contract.<\\\/p>

    Jurisdictional Regulation<\\\/p>

    The contract relationship between the organizing Agency and the client will be ruled by Law 301\\\/2002 \\u201cDECRETO 301\\\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\\u00fam. 150, de 21 de Diciembre de 2002)\\u201d<\\\/p>

    Fees<\\\/p>

    Fees shall be expressed in Euro(EUR) or United States Dollars (U$). They include the \\u00edtems detailed as \\u201cincluded\\u201d at the Reservation Form and on the Client\\u2019s Itinerary apart from the Value Added Tax (VAT) unless otherwise stated. It does not include visas, airport taxes or other , vaccination certificates, nor any other services not specified as \\u201cincluded\\u201d.<\\\/p>

    In case payment is in U$D the exchange rate will be the exchange rate valid at the date of payment determined by the European Central Bank<\\\/p>

    The fees shall be valid during the time detailed in each case. Once this time is over, they will not be valid. They are subject to variation without any prior notice , when the variation of the costs of the services justify such variation. Moreover, any variation of the fees could cause a revision of the final quoting of a Service. These variations shall be notified to the client \\u2013 who will have the option of accepting the new conditions of the contract or ask for a cancellation of his travel contract \\u2013in case the increase is over 15% of the total price of the contract \\u2013 or he can accept the contract as modified.<\\\/p>

    No modification of the fees shall be possible as from 30 days prior to the date of the Service, when a requirement of services has already been confirmed.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Even though the contracting of air or land transport where carried out through the Agency ARGENTINA PURA S.L., the use of them by the clients implies a direct relationship between the clients and such transport companies . The Agency ARGENTINA PURA S.L. will thus not be responsible for any inconvenience arising from the services provided by them.<\\\/p>

      As regards the air tickets \\u2013 once the Initial Deposit is done \\u2013 the reservations are carried out but the tickets will not be issued. Should the client want to have his tickets issued, he shall pay for their total amount \\u2013 thus also avoiding any possible increase of the ticket fees.<\\\/p><\\\/li><\\\/ul><\\\/div><\\\/div><\\\/div><\\\/div>

      Payment Conditions<\\\/p>

      As mentioned on the previous \\u00edtem, in order for ARGENTINA PURA S.L. to confirm the Reservation of a service , a deposit of no less than 50% of its total amount shall be done. The balance shall be paid to ARGENTINA PURA S.L. at least 15 days prior to the date in which the Service shall be provided.<\\\/p>

      In case such balance was not paid within such date, ARGENTINA PURA S.L. will consider the reservation as canceled by the client. In the case of Reservations made with less than 15 days anticipation of the date of departure, the full amount will be required with no delay.<\\\/p>

      Changes by ARGENTINA PURA S.L.<\\\/p>

      Even though our commercial policies are aimed at satisfying each of our clients, carrying out services as arranged on the binding contract, there could exist special circumstances compelling us to alter the original Reservation. By binding himself to this contract the client accepts that it could be necessary to modify the content of the itinerary due to local situations. ARGENTINA PURA S.L. will have the right to partially or totally modify the itinerary of the services contracted including fees, flights, lodging or any other services and to substitute them for alternative services of similar value with no compensation whatsoever, either in money or any other way.<\\\/p>

      If ARGENTINA PURA S.L. judges it is necessary to make a substantial modification they shall inform the client as soon as possible about those changes. The client can choose a) to accept such changes, b)to change those services by other available services, provided they do not modify costs or they pay for the differences , c) to cancel the contracted services.<\\\/p>

      Cancellations by ARGENTINA PURA S.L.<\\\/p>

      ARGENTINA PURA S.L. has the right to partially or totally cancel the original Reservation due to causes beyond the company such as: No show of passengers, any event which might be against the personal \\\/group safety and act against the normal development of the activity or activities or due to an act of God. In any such case the client will not have a reimbursement of the paid fees.<\\\/p>

      Changes by Clients<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Changes or modifications to the original Reservation cannot be guaranteed for they are subject to availability . In case any passenger wanted to change an original Reservation, the passenger who signed the Reservation Form will state so by mail or fax. Any cost arising from such changes shall be paid by the Client.<\\\/p>

      Cancellations by Clients<\\\/p>

      Clients can cancel the Reservation at any moment, provided that such cancellation is communicated to ARGENTINA PURA S.L. in writing \\u2013 by email or phone.       In case ARGENTINA PURA S.L. had made changes to the original Reservation of a contracted Service and the client chose to cancel it, ARGENTINA PURA S.L. shall pay the full amount \\u2013 provided the changes were not caused by the Act of God.<\\\/p>

      In such cases the Client shall not receive reimbursement of the amount paid.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      ARGENTINA PURA S.L. is not responsible for any charge whatsoever in case of a change \\u2013beyond his control- of time or day of departure of a tour, flight or any other means of transport.<\\\/p>

      Act of God herein means : \\u201cA violent and unexpected event, beyond human will and for this reason unpredictable and of inevitable consequences\\u201d.<\\\/p>

      Examples: wars, war threats, riots, civil or industrial dispute, terrorist activities, natural or nuclear disasters , fire or adverse climatic conditions. Technical problems on problems of maintenance of means of transport, changes deriving from canceling or reprogramming of flights of an airline, alteration of the airline or of the type of airship or any other similar events beyond the control of ARGENTINA PURA S.L.<\\\/p>

      As regards partial cancellations they will be analyzed in each case, and in case they brought about additional charges they will be paid by the client.<\\\/p>

      Documents, visas and sanitary requirements.<\\\/p>

      The Clients who have bought any of our Tourist Services and appear on the binding contract are responsible for the correctness of their documents for entering and for free circulating within the country to be visited. Examples of these documents: identification documents , passports, visas, sanitary documents, etc.<\\\/p>

      In case that, due to lack or incorrection of the necessary documents for the trip, a client was delayed or should cancel or abandon the trip partially or totally , ARGENTINA PURA S.L. will not be held responsible, in which case there will be no reimbursement.<\\\/p>

      Underage -less than 18- shall submit a document signed by parents authorizing them to travel.<\\\/p>

      Diseases and Disabilities<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Once the binding contract between ARGENTINA PURA S.L. and the client is formalized the Client must inform ARGENTINA PURA S.L. if he has any disease or disability or he is on a treatment for any special condition either physical or medical. The Client will be responsible for all the necessary arrangements for the provision of his medicines or any other treatments that might be necessary during the trip or any of the services included.
