Allgemeine Bedingungen f\u00fcr die Beauftragung touristischer Dienstleistungen<\/p>

ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 ausdr\u00fccklich erkl\u00e4rt:<\/p>

Jeder, der eine der Dienstleistungen in Anspruch nimmt, deren technische Organisation von Argentina Pura S.L. durchgef\u00fchrt wurde, akzeptiert die vorliegenden allgemeinen Gesch\u00e4ftsbedingungen, die automatisch in den Vertrag aufgenommen werden, ohne dass es einer schriftlichen Abfassung auf dem Vertrag bedarf.<\/p>

Zust\u00e4ndigkeitsverordnung<\/p>

Das Vertragsverh\u00e4ltnis zwischen der organisierenden Agentur und dem Kunden wird durch das Gesetz 301\/2002 \"DECRETO 301\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\u00fam. 150, de 21 de Diciembre de 2002)\"<\/p>

Geb\u00fchren<\/p>

Die Geb\u00fchren werden in Euro (EUR) oder in US Dollar (U$) angegeben. Sie beinhalten die im Reservierungsformular und im Reiseplan des Kunden als \"inbegriffen\" aufgef\u00fchrten Leistungen, mit Ausnahme der Mehrwertsteuer, sofern nicht anders angegeben. Nicht inbegriffen sind Visa, Flughafengeb\u00fchren oder andere, Impfbescheinigungen oder andere nicht als \"inbegriffen\" angegebene Leistungen.<\/p>

Bei Zahlung in U$D ist der Wechselkurs der zum Zeitpunkt der Zahlung g\u00fcltige, von der Europ\u00e4ischen Zentralbank festgelegte Wechselkurs.<\/p>

Die Geb\u00fchren sind w\u00e4hrend des jeweils angegebenen Zeitraums g\u00fcltig. Nach Ablauf dieses Zeitraums sind sie nicht mehr g\u00fcltig. Sie k\u00f6nnen ohne vorherige Ank\u00fcndigung ge\u00e4ndert werden, wenn die \u00c4nderung der Kosten f\u00fcr die Dienstleistungen eine solche \u00c4nderung rechtfertigt. Au\u00dferdem kann jede \u00c4nderung der Geb\u00fchren zu einer \u00c4nderung des endg\u00fcltigen Kostenvoranschlags f\u00fcr eine Dienstleistung f\u00fchren. Diese \u00c4nderungen werden dem Kunden mitgeteilt, der dann die M\u00f6glichkeit hat, die neuen Vertragsbedingungen zu akzeptieren oder die Annullierung seines Reisevertrags zu verlangen, falls die Erh\u00f6hung mehr als 15% des Gesamtpreises des Vertrags betr\u00e4gt, oder den Vertrag in der ge\u00e4nderten Form zu akzeptieren.<\/p>

Eine \u00c4nderung der Geb\u00fchren ist ab 30 Tagen vor dem Datum der Dienstleistung nicht mehr m\u00f6glich, wenn ein Bedarf an Dienstleistungen bereits best\u00e4tigt wurde.<\/p><\/div><\/div><\/div><\/div>

  • \u25cf D\u00edas: Lunes a ViernesComienzo del ContratoEl contrato vinculante entre ARGENTINA PURA S.L. y el Cliente comienza a partir de la fecha en que ARGENTINA PURA S.L. recibe efectivamente el Formulario de Reserva con los datos personal completos del cliente por correo o tel\u00e9fono y el Dep\u00f3sito Inicial del Servicio a contratar. Su importe no podr\u00e1 ser inferior al 50% del valor total de la misma, salvo que -por causas especiales- se requiera otra suma adicional.A partir del momento en que el contrato vinculante entre ARGENTINA PURA S.L. es v\u00e1lido, el cliente acepta en su totalidad los t\u00e9rminos y condiciones generales aqu\u00ed descritos.     Auch wenn der Vertrag von Luft- oder Landtransport durch die Agentur ARGENTINA PURA S.L. durchgef\u00fchrt wurde, impliziert die Verwendung von ihnen durch die Kunden eine direkte Beziehung zwischen den Kunden und diesen Transportunternehmen. Die Agentur ARGENTINA PURA S.L. haftet daher nicht f\u00fcr Unannehmlichkeiten, die sich aus den von ihnen erbrachten Dienstleistungen ergeben.<\/p>

    Was die Flugtickets anbelangt, so werden nach der ersten Anzahlung die Reservierungen vorgenommen, aber die Tickets werden nicht ausgestellt. Sollte der Kunde seine Tickets ausgestellt haben wollen, muss er den Gesamtbetrag bezahlen, um eine m\u00f6gliche Erh\u00f6hung der Ticketgeb\u00fchren zu vermeiden.<\/p><\/li><\/ul><\/div><\/div><\/div><\/div>

    Zahlungsbedingungen<\/p>

    Wie bereits im vorhergehenden Punkt erw\u00e4hnt, muss ARGENTINA PURA S.L. eine Anzahlung von mindestens 50% des Gesamtbetrages leisten, damit die Reservierung einer Dienstleistung best\u00e4tigt werden kann. Der Restbetrag muss mindestens 15 Tage vor dem Datum, an dem die Dienstleistung erbracht werden soll, an ARGENTINA PURA S.L. \u00fcberwiesen werden.<\/p>

    Falls der Restbetrag nicht innerhalb dieser Frist gezahlt wurde, betrachtet ARGENTINA PURA S.L. die Reservierung als vom Kunden storniert. Im Falle von Reservierungen, die weniger als 15 Tage vor dem Abreisedatum get\u00e4tigt werden, wird der volle Betrag ohne Verz\u00f6gerung verlangt.<\/p>

    \u00c4nderungen durch ARGENTINA PURA S.L.<\/p>

    Obwohl unsere Gesch\u00e4ftspolitik darauf abzielt, jeden unserer Kunden zufrieden zu stellen, indem wir die Dienstleistungen so ausf\u00fchren, wie sie im verbindlichen Vertrag vereinbart wurden, kann es besondere Umst\u00e4nde geben, die uns zwingen, die urspr\u00fcngliche Reservierung zu \u00e4ndern. Durch die Bindung an diesen Vertrag akzeptiert der Kunde, dass es notwendig sein k\u00f6nnte, den Inhalt der Reiseroute aufgrund der \u00f6rtlichen Gegebenheiten zu \u00e4ndern. ARGENTINA PURA S.L. beh\u00e4lt sich das Recht vor, den Reiseverlauf der vertraglich vereinbarten Leistungen, einschlie\u00dflich der Geb\u00fchren, Fl\u00fcge, Unterk\u00fcnfte oder anderer Leistungen, teilweise oder vollst\u00e4ndig zu \u00e4ndern und sie durch alternative Leistungen von gleichem Wert zu ersetzen, ohne dass daf\u00fcr eine Entsch\u00e4digung in Form von Geld oder auf andere Weise erfolgt.<\/p>

    Wenn ARGENTINA PURA S.L. es f\u00fcr notwendig h\u00e4lt, eine wesentliche \u00c4nderung vorzunehmen, wird sie den Kunden so schnell wie m\u00f6glich \u00fcber diese \u00c4nderungen informieren. Der Kunde hat die Wahl, a) die \u00c4nderungen zu akzeptieren, b) die Leistungen durch andere verf\u00fcgbare Leistungen zu ersetzen, sofern sich die Kosten nicht \u00e4ndern oder er f\u00fcr die Differenzen aufkommt, c) die vertraglichen Leistungen zu stornieren.<\/p>

    Annullierungen durch ARGENTINA PURA S.L.<\/p>

    ARGENTINA PURA S.L. hat das Recht, die urspr\u00fcngliche Reservierung teilweise oder ganz zu stornieren, wenn Gr\u00fcnde vorliegen, die au\u00dferhalb des Unternehmens liegen, wie z.B.: Nichterscheinen der Passagiere, jedes Ereignis, das gegen die pers\u00f6nliche \/ Gruppensicherheit und gegen die normale Entwicklung der Aktivit\u00e4t oder Aktivit\u00e4ten oder aufgrund h\u00f6herer Gewalt handeln k\u00f6nnte. In einem solchen Fall hat der Kunde keinen Anspruch auf R\u00fcckerstattung der gezahlten Geb\u00fchren.<\/p>

    \u00c4nderungen durch Kunden<\/p><\/div><\/div><\/div><\/div>

    \u00c4nderungen an der urspr\u00fcnglichen Reservierung k\u00f6nnen nicht garantiert werden, da sie von der Verf\u00fcgbarkeit abh\u00e4ngig sind. Falls ein Passagier eine urspr\u00fcngliche Reservierung \u00e4ndern m\u00f6chte, muss der Passagier, der das Reservierungsformular unterzeichnet hat, dies per Post oder Fax mitteilen. Alle Kosten, die durch solche \u00c4nderungen entstehen, sind vom Kunden zu tragen.<\/p>

    Stornierungen durch Kunden<\/p>

    Der Kunde kann die Reservierung jederzeit stornieren, vorausgesetzt, die Stornierung wird ARGENTINA PURA S.L. schriftlich - per E-Mail oder telefonisch - mitgeteilt. Ab dem Datum des Eingangs der Stornierungsmitteilung werden die folgenden Geb\u00fchren erhoben:<\/p><\/div><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    Falls ARGENTINA PURA S.L. \u00c4nderungen an der urspr\u00fcnglichen Reservierung einer vertraglich vereinbarten Leistung vorgenommen hat und der Kunde diese stornieren m\u00f6chte, zahlt ARGENTINA PURA S.L. den vollen Betrag, sofern die \u00c4nderungen nicht durch h\u00f6here Gewalt verursacht wurden.<\/p>

    In solchen F\u00e4llen erh\u00e4lt der Kunde keine R\u00fcckerstattung des gezahlten Betrags.<\/p><\/div><\/div><\/div><\/div>

    ARGENTINA PURA S.L. ist nicht verantwortlich f\u00fcr irgendwelche Kosten im Falle einer \u00c4nderung der Abfahrtszeit oder des Abfahrtsdatums einer Tour, eines Fluges oder eines anderen Transportmittels, die au\u00dferhalb seiner Kontrolle liegen.<\/p>

    H\u00f6here Gewalt bedeutet hier: \"Ein gewaltsames und unerwartetes Ereignis, das sich dem menschlichen Willen entzieht und daher unvorhersehbar ist und unausweichliche Folgen hat\".<\/p>

    Beispiele: Kriege, Kriegsdrohungen, Unruhen, Zivil- oder Arbeitskonflikte, terroristische Aktivit\u00e4ten, Natur- oder Atomkatastrophen, Br\u00e4nde oder ung\u00fcnstige klimatische Bedingungen. Technische Probleme bei der Wartung von Transportmitteln, \u00c4nderungen, die sich aus der Streichung oder Neuprogrammierung von Fl\u00fcgen einer Fluggesellschaft ergeben, \u00c4nderung der Fluggesellschaft oder des Luftfahrzeugtyps oder andere \u00e4hnliche Ereignisse, die au\u00dferhalb der Kontrolle von ARGENTINA PURA S.L. liegen.<\/p>

    Was die teilweisen Stornierungen betrifft, so werden diese von Fall zu Fall gepr\u00fcft, und falls sie zus\u00e4tzliche Kosten verursachen, werden diese vom Kunden getragen.<\/p>

    Dokumente, Visa und sanit\u00e4re Anforderungen.<\/p>

    Die Kunden, die eine unserer touristischen Dienstleistungen gekauft haben und im verbindlichen Vertrag erscheinen, sind f\u00fcr die Korrektheit ihrer Dokumente f\u00fcr die Einreise und den freien Verkehr innerhalb des zu besuchenden Landes verantwortlich. Beispiele f\u00fcr diese Dokumente: Ausweisdokumente, Reisep\u00e4sse, Visa, Gesundheitspapiere, etc.<\/p>

    Sollte der Kunde aufgrund des Fehlens oder der Unvollst\u00e4ndigkeit der f\u00fcr die Reise erforderlichen Dokumente eine Versp\u00e4tung erleiden oder die Reise ganz oder teilweise stornieren oder abbrechen m\u00fcssen, kann ARGENTINA PURA S.L. nicht haftbar gemacht werden, und es erfolgt keine R\u00fcckerstattung.<\/p>

    Minderj\u00e4hrige - unter 18 Jahren - m\u00fcssen ein von den Eltern unterzeichnetes Dokument vorlegen, das sie zur Reise berechtigt.<\/p>

    Krankheiten und Behinderungen<\/p><\/div><\/div><\/div><\/div>

    Sobald der verbindliche Vertrag zwischen ARGENTINA PURA S.L. und dem Kunden zustande gekommen ist, muss der Kunde ARGENTINA PURA S.L. dar\u00fcber informieren, wenn er an einer Krankheit oder Behinderung leidet oder sich wegen eines besonderen k\u00f6rperlichen oder medizinischen Zustands in Behandlung befindet. Der Kunde ist verantwortlich f\u00fcr alle notwendigen Vorkehrungen f\u00fcr die Versorgung mit Medikamenten oder anderen Behandlungen, die w\u00e4hrend der Reise oder der inbegriffenen Dienstleistungen notwendig sein k\u00f6nnten.     General Conditions for contracting Tourist Services<\\\/p>

    ARGENTINA PURA S.L. - CIF: B67787275 - C.I.AN. 297593-3 explicitly states:<\\\/p>

    Anyone contracting any of the services of which technical organization was carried out by Argentina Pura S.L totally accepts these general terms and conditions, which will be considered automatically incorporated to the contract with no need of a written transcription of them on the contract.<\\\/p>

    Jurisdictional Regulation<\\\/p>

    The contract relationship between the organizing Agency and the client will be ruled by Law 301\\\/2002 \\u201cDECRETO 301\\\/2002, DE 17 DE DICIEMBRE, DE AGENCIAS DE VIAJES. 1 (B.OJ.A. n\\u00fam. 150, de 21 de Diciembre de 2002)\\u201d<\\\/p>

    Fees<\\\/p>

    Fees shall be expressed in Euro(EUR) or United States Dollars (U$). They include the \\u00edtems detailed as \\u201cincluded\\u201d at the Reservation Form and on the Client\\u2019s Itinerary apart from the Value Added Tax (VAT) unless otherwise stated. It does not include visas, airport taxes or other , vaccination certificates, nor any other services not specified as \\u201cincluded\\u201d.<\\\/p>

    In case payment is in U$D the exchange rate will be the exchange rate valid at the date of payment determined by the European Central Bank<\\\/p>

    The fees shall be valid during the time detailed in each case. Once this time is over, they will not be valid. They are subject to variation without any prior notice , when the variation of the costs of the services justify such variation. Moreover, any variation of the fees could cause a revision of the final quoting of a Service. These variations shall be notified to the client \\u2013 who will have the option of accepting the new conditions of the contract or ask for a cancellation of his travel contract \\u2013in case the increase is over 15% of the total price of the contract \\u2013 or he can accept the contract as modified.<\\\/p>

    No modification of the fees shall be possible as from 30 days prior to the date of the Service, when a requirement of services has already been confirmed.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Even though the contracting of air or land transport where carried out through the Agency ARGENTINA PURA S.L., the use of them by the clients implies a direct relationship between the clients and such transport companies . The Agency ARGENTINA PURA S.L. will thus not be responsible for any inconvenience arising from the services provided by them.<\\\/p>

      As regards the air tickets \\u2013 once the Initial Deposit is done \\u2013 the reservations are carried out but the tickets will not be issued. Should the client want to have his tickets issued, he shall pay for their total amount \\u2013 thus also avoiding any possible increase of the ticket fees.<\\\/p><\\\/li><\\\/ul><\\\/div><\\\/div><\\\/div><\\\/div>

      Payment Conditions<\\\/p>

      As mentioned on the previous \\u00edtem, in order for ARGENTINA PURA S.L. to confirm the Reservation of a service , a deposit of no less than 50% of its total amount shall be done. The balance shall be paid to ARGENTINA PURA S.L. at least 15 days prior to the date in which the Service shall be provided.<\\\/p>

      In case such balance was not paid within such date, ARGENTINA PURA S.L. will consider the reservation as canceled by the client. In the case of Reservations made with less than 15 days anticipation of the date of departure, the full amount will be required with no delay.<\\\/p>

      Changes by ARGENTINA PURA S.L.<\\\/p>

      Even though our commercial policies are aimed at satisfying each of our clients, carrying out services as arranged on the binding contract, there could exist special circumstances compelling us to alter the original Reservation. By binding himself to this contract the client accepts that it could be necessary to modify the content of the itinerary due to local situations. ARGENTINA PURA S.L. will have the right to partially or totally modify the itinerary of the services contracted including fees, flights, lodging or any other services and to substitute them for alternative services of similar value with no compensation whatsoever, either in money or any other way.<\\\/p>

      If ARGENTINA PURA S.L. judges it is necessary to make a substantial modification they shall inform the client as soon as possible about those changes. The client can choose a) to accept such changes, b)to change those services by other available services, provided they do not modify costs or they pay for the differences , c) to cancel the contracted services.<\\\/p>

      Cancellations by ARGENTINA PURA S.L.<\\\/p>

      ARGENTINA PURA S.L. has the right to partially or totally cancel the original Reservation due to causes beyond the company such as: No show of passengers, any event which might be against the personal \\\/group safety and act against the normal development of the activity or activities or due to an act of God. In any such case the client will not have a reimbursement of the paid fees.<\\\/p>

      Changes by Clients<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Changes or modifications to the original Reservation cannot be guaranteed for they are subject to availability . In case any passenger wanted to change an original Reservation, the passenger who signed the Reservation Form will state so by mail or fax. Any cost arising from such changes shall be paid by the Client.<\\\/p>

      Cancellations by Clients<\\\/p>

      Clients can cancel the Reservation at any moment, provided that such cancellation is communicated to ARGENTINA PURA S.L. in writing \\u2013 by email or phone.       In case ARGENTINA PURA S.L. had made changes to the original Reservation of a contracted Service and the client chose to cancel it, ARGENTINA PURA S.L. shall pay the full amount \\u2013 provided the changes were not caused by the Act of God.<\\\/p>

      In such cases the Client shall not receive reimbursement of the amount paid.<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      ARGENTINA PURA S.L. is not responsible for any charge whatsoever in case of a change \\u2013beyond his control- of time or day of departure of a tour, flight or any other means of transport.<\\\/p>

      Act of God herein means : \\u201cA violent and unexpected event, beyond human will and for this reason unpredictable and of inevitable consequences\\u201d.<\\\/p>

      Examples: wars, war threats, riots, civil or industrial dispute, terrorist activities, natural or nuclear disasters , fire or adverse climatic conditions. Technical problems on problems of maintenance of means of transport, changes deriving from canceling or reprogramming of flights of an airline, alteration of the airline or of the type of airship or any other similar events beyond the control of ARGENTINA PURA S.L.<\\\/p>

      As regards partial cancellations they will be analyzed in each case, and in case they brought about additional charges they will be paid by the client.<\\\/p>

      Documents, visas and sanitary requirements.<\\\/p>

      The Clients who have bought any of our Tourist Services and appear on the binding contract are responsible for the correctness of their documents for entering and for free circulating within the country to be visited. Examples of these documents: identification documents , passports, visas, sanitary documents, etc.<\\\/p>

      In case that, due to lack or incorrection of the necessary documents for the trip, a client was delayed or should cancel or abandon the trip partially or totally , ARGENTINA PURA S.L. will not be held responsible, in which case there will be no reimbursement.<\\\/p>

      Underage -less than 18- shall submit a document signed by parents authorizing them to travel.<\\\/p>

      Diseases and Disabilities<\\\/p><\\\/div><\\\/div><\\\/div><\\\/div>

      Once the binding contract between ARGENTINA PURA S.L. and the client is formalized the Client must inform ARGENTINA PURA S.L. if he has any disease or disability or he is on a treatment for any special condition either physical or medical. The Client will be responsible for all the necessary arrangements for the provision of his medicines or any other treatments that might be necessary during the trip or any of the services included.
